Defense for Meth Lab Charges in New York State
In the NYC area, the police are working hard to crack down on the illegal manufacturing and illegal use of methamphetamine. With the increased effort to remove these drugs from the streets, many people are being caught in the web of law enforcement. They’re identifying more users and raiding meth labs to rid the streets of the illegal stimulant.
What is Methamphetamine?
Methamphetamine is also called meth, speed, crystal, crank or crystal meth. It’s highly addictive, and it can increase energy and cause people to feel euphoric. While many meth labs are making the drug illegally, there are some people who receive methamphetamine as a prescription for treatment of ADD or obesity.
Charged with Possession
Anyone who has access to meth without a prescription can be charged with possession. Possession is a serious crime that carries varying degrees of prison time. Less than 1/2 an ounce of meth is criminal possession in the 7th degree. Criminal possession in the 4th degree comes from 1/2 ounce or more, which is a class C felony and punishable by 1 to 5 years in prison. Offenders who have been convicted previously can face up to 8 years in prison.
If arrested with 2 ounces or more of meth or a mixture containing meth, the person can face criminal possession in the 2nd degree, which is a class A-II and carries a 3 to 10 year sentence.
Drug Manufacturing
A person arrested for making meth with the intent to sell it can see higher prison sentences than someone who is in possession of the drug. Possession with the intent to sell less than 5 grams of meth or less than 50 grams of mixtures containing meth can see up to 20 years in jail. Fines can total close to 1 million dollars.
Anyone arrested with 5 grams or more or 50 grams of the mixture will spend at least 5 years in prison if convicted. The maximum might be 40 years in prison and a maximum fine of 2 million dollars.
If you’re arrested with more than 50 grams for sale or a mixture of meth from a lab, you can see a minimum of 10 years in prison and a maximum of life imprisonment. Fines can reach close to 4 million dollars.
